Skilled Worker ILR

Dear Zimba / Experts

back on this forum after long and asking for my brother as i am helping him make is ILR application SW route with wife and 2 children. Just to ensure that I am not missing anything, kindly comment if anuything else is required.

Main Applicant:
1. Payslips for main applicant last 6 months. (or do I need more)
2. Do i need to attach matching bank statments for last 6 months as well ?
3. If so, sometimes dates have differed by 5-10 days. WIll this be a problem ?
4. English language test needed ?
5. LIUK - its done
6. CoS copy ?
7. Letter from employer to say employment is continuous while confirming salary.
8. Form will be Set O ?

Wife:
1. LIUK is done.
2. English test needed ?
3. She works as a doctor in hospital. Does she need to attach payslip, work letter etc ?
4. Proofs of address ?
5. Anything else needed ?


Children 2 - under 16
1. just passports ?

Thanks and i am hoping someone maybe able to guide here.

For the main applicant only the latest payslip and bank statement is needed. The dates do not need to match. There is no English language requirement.

For employer letter: All you need to know about the sponsor letter for Skilled Worker route

For the dependant, there is no finical or employment requirement. Do not send unnecessary evidence.

Provide cohabitation evidence: All you need to know about cohabitation evidence

All apply using a single SET(O) form

Thanks mate for prompt response. Times have changed since you helped me with ILR few years ago but your assistance is still the same. Can't thank enough.

Final bit. For dependent (wife), I see she has to prove english however would you know if she is able to prove that based on the GMC registration or the FRCS qualification she has from UK ? We're quite confused whether this will be okay as acceptable proof.

Those are occupational English tests and they are not accepted under the immigration requirements. Under the rules, you're required to pass a secure English test. She must sit a SELT test

I have just viewed the guideline on UK Home Office English Language Appendix and page 20 of the appendix, it states as below :

"Additional option for Skilled Worker applications Medical professional regulation This section explains additional ways in which Skilled Workers can meet the English language requirement. If an applicant is being sponsored to work as a doctor, dentist, nurse, or midwife they will meet the English language requirement if they have passed an English language assessment which is accepted as a requirement for registration by the relevant regulated professional body in the United Kingdom. As the assessment is a requirement for registration and employment by the sponsor, you do not need to do further checks where the applicant is applying under one of these SOC codes: • 2211 – Generalist medical practitioners • 2212 – Specialist medical practitioners • 2231 – Midwifery nurses • 2232 – Registered community nurses • 2233 – Registered specialist nurses • 2234 – Registered nurse practitioners • 2235 – Registered mental health nurses • 2236 – Registered children’s nurses • 2237 – Other registered nursing professionals • 2253 – Dental practitioners
If there are reasons to doubt their occupation, you can check they are registered with their relevant professional body here: • Doctors - General Medical Council • Dentists - General Dental Council • Nurses and Midwives – Nursing and Midwifery Council "

My brothers wife is his dependent (he is on skilled worker) so above wont apply to her ? even though she is on GMC register and got her GMC registration after passing english in 2014 as above article is for skilled worker only ?

It seems to apply to the sponsored main skilled workers relevant for their entry clearance/extension (as ILR has no English language requirement for the main applicants at all). It does not mention the dependants under this rule:
EL 9.1. An applicant applying for entry clearance or permission to stay under Appendix Skilled Worker will meet the English language requirement if they are being sponsored to work as a doctor, dentist, nurse, midwife or veterinarian, and have passed an English Language assessment which is accepted by the relevant regulated professional body as a requirement for registration.

Hi Zimba / Experts

One other question which is regarding the salary. He got the skilled worker visa on SOC code 2124 - Electronics engineer in July 2021 and salary he was on was £35,000 per annum. Will the new salary apply as new salary for 2124 is 52,000 or he will still be okay for the salary threshold which was at the time of application ?
