When does the eligibility date is counted?

Hi All, I came to UK on March 2019 on ICT visa then on 21st Nov 2021 got my Tier 2 visa for 5 years and joined the job in Jan 2022.During the period from Nov till Jan I was serving notice to the previous employer. I worked in the company for 2 years in the same role as a BA then there was a role change from BA to Management Consultant so the same employer requested for skilled visa with new COS and all. In that company I stayed for 3 years till 16th Feb 2025 and then changed job to a different company in skilled visa on 17th Feb 2025 as a BA. My current visa expires on 27th March 2027. However as per my tenure I am due to apply for ILR on 24th Oct 2026. Do you foresee any issue in visa timelines and changing companies. Also the COS and certificates have to be provided by the current companies or do I require any documents from the previous company as well? Appreciate your guidance with this.

No issues with changing jobs.

A CoS is not required to apply for ILR. Nothing is required from previous employers.

Thanks can you let me know when would be the earliest possible time to apply for the ILR if I have the visa starting from 21st Nov 2021? Just wanted to cross check and also my dependents got the visa 7th Dec 2021 so shall I wait for them to complete their tenure and go ahead or straightaway go ahead with mine and then do theirs when they are eligible. I want to do it as soon as I am eligible just to avoid any visa changes effecting and I am the the primary account holder. Appreciate your thoughts.

You're eligible for ILR on 21st Nov 2021 + 5 years - 28 days. The eligibility is based on the date UKVI takes a decision on the ILR application.

1. You submit the application
2. Enrol biometrics
3. Ensure UKVI decision occurs in a date within the eligibility period (21st Nov 2021 + 5 years - 28 days)

Your dependants are eligible for ILR on 7th Dec 2021 + 5 years - 28 days and the above applies to them too.

Accordingly my dependents got the visa on 7th Dec 2021 and would be eligible on 9th Nov 2026. Can you let me know usually the case worker start counting the eligibility from the day the application was submitted or post the biometric appointment date? As in If I submit my application on 25th Oct 2026 for all of us(including my dependent) however go ahead with a biometric appointment date at 11th Nov 2026. Once the case worker picks up my application will he consider my ILR eligibility date from 11th Nov 2026 or 25th Oct 2026. As in that case even though I would be eligible but my dependents wont (incase he/she considers 25th Oct 2026).Hope I was able to explain my situation. Need suggestion. Thanks

Thanks a lot for the info. Also I would like to know that on 10 May 2023 when I was on skilled visa. I have got a speeding ticket ( intention to procecute) for which I did the speed awareness course. My points were not deducted and I didn’t get any penalty. In the. Criminal history which point will be valid in this case and do I need to inform this as well? And also I got an euro car parking ticket from Morrisons which I contested and it was been cancelled. Please suggest.

You do not need to declare any of those.

1. A speed awareness course is managed through the National Driver Offender Retraining Scheme (NDORS) and is kept on a police database for eligibility, but it does not count as a motoring conviction

2. What about the PCNs ? Well the PCN abbreviation is deliberately confusing.

When you get a PCN from council, stands for Penalty charge Notice and it is issued for failing to obey the law on public roads. Such PCN is NOT issued under your name and you do not need to declare it. The non-payment of this PCN is an offence.

However, a private company PCN stands for Parking charge Notice (it is like an invoice for parking on private land) You are not legally required to pay. This is like not paying an invoice. It has no effect on your life. Non-payment of this is NOT an offence but a civil issue, between you and a private compnay.

Hi, Thanks for the information. However just wanted to verify in the Convictions and penalties, I am a bit confused on the option 2 and 4 which are 2) A penallty for a driving offense, for eg. disqualification for speed, no motor insurance and 4) A caution, warning, reprimand or other out of court penalty. Will my speeding ticket be counted in it?
