No, it is not mandatory that you have a representative with you. It is not a complciated case. By doing little bit of research, you can even represent yourself on the hearing date. It is not a rocket science. However even if you wish to choose a represetative then kindly do not pay more than £750 for the whole service. You can find loads of solicitors charging in this range by doing little bit of research. However make sure that choosen representative is a competative one and do understand AIT appeal process in depth.Ting wrote:Thanks for your reply,
My visa expired as you know how long the process noramlly takes for HO.
If I lodge an appeal, do I need a representative specilised in immigration or just a solicitor in general as I can prove that I do have enough funds?
Should I reqire any evidence for the policy of HSBC not to stamp or sign as the argue point?
I think statement should be on official stationary of the bank (official staniary contains printed name and logo of the bank)megastar wrote:sorry to hear about your refusal.
is that printed statements have your name and account number?
as far as i know, according to HO guidance(source:UKCISA email)the application should not be refused solely on the grounds of supporting letter from bank is missing.
you better speak to a solicitor. contact IASUK ( www.iasuk.org ). they offer free service*.
it is same with me.. they refused my psw, appealed.. even i put letter from bank manager confirming the authenticity of statement which the idiot judge never considered .. again refused (later got fax to my representative that decision is cancelled and do wait until another decision is made). appealing to high court.
best of luck...
andThe letter from a bank or building society should state:
* your name;
* the account number;
* the date of the letter;
* the financial institution's name and logo;
* the funds held in your account; and
* that enough funds have been in the bank for at least three months.
[/b]The personal bank or building society statements should clearly show:
* your name;
* the account number;
* the date of the statement;
* the financial institution's name and logo;
* transactions covering the three-month period;
* that there is enough funds present in the account; and
* that there has been enough money present in the account for the past three months.
If you wish to send electronic bank statements from an online account these must contain all of the details listed above. In addition, you will need to send a supporting letter from your bank, on headed paper, confirming that the statements are genuine. Alternatively, electronic bank statements with the official stamp of the bank that issued the statements will be accepted. The stamp must appear on every page of the statement.
We will not accept statements which simply show the balance in the account on a particular day as these documents do not show that you hold enough funds for the full period required.
It is written on your refusal letter if you have right to appeal or not. No one in this forum can tell if you have right to appeal.Ting wrote:Hi,
thanks to everyone. After seeing the quote, it feels like the chance of winning the appeal is dropping. However, the bank printed the statement with their name on it coz they ran out of that paper.......
and at the same time, they don't stamp or sign any of the papers they print, that's why I am here now.
Does any one think I have a chance to appeal?
I am really worried.
I checked the IAS, telephone service 30 pounds......
need help, thanks again
hi ting dont be upset. what is the date of the refusal letter? i am mean when they took the decison of refusal it should be in the letter that they send. and from that date you have a grace period of 28 days( some one says 5 days) to make fresh application, or appeal or leave the country. so if you have all the required paper ready you can make a fresh application if your refusal date is less than 28 days. contact any experienced solicitor. i posted a thread where i mentioned about my room mates casee. he was in igs and applied for tier 1 general and got refused but in the mean time igs was also expired but then he applied for psw with expired igs. but he got his psw. so please consult any experienced consultant. i can recomend one if you like www.still-unclear.co.ukTing wrote:Dear All,
I just spoke to UKCISA, explained all the situation to them and they said that my have no ground of appal as it was my dicision to send the bank statement which wasn't official.
I am very upset now. The only thing I can do is going back to Taiwan and apply for a student visa to come back if it is granted to finish my dissertation as I originally applied for IGS was to be able to work full time.
thanks to everyone
ting, as i said there is grace period after your visa refusal to make new application. yes in the letter it says in any case of new application you have to apply before your current leave expires. and here is the catch, technicaly your current leave will not expire during this grace period no matter what says on your visa. i said this from my own experience of my room mate. and consult with some experienced immigration consultant. i am 100% positive, there is grace period for making new application after your first refusal no matter when your visa expires. as you said your letter says 9/1/09. so you still have time but time is running out very quickly. you need to act fast..Ting wrote:Hi all,
thanks for your reply.
09/01/2009 is the date which printed on the front paper of UK border agency. 13/01/2009 is the date shown on the appeal foram which says "Date of service" and the appeal deadline is 27/01/2009. I assume that if I leave before 27th of Jan, I should be alright?
As I mentioned before, I was adv to contact UKCISA by my International Student Office Advisor and they said that this visa you can't re-submit documents that you originally could provide, therefore, I don't have any ground to appeal........and it says, in all cases, new application can only be accepted when your current visa is not expired..... I am in the situation of both of them....God what have I done.
Hopefully, coz I am still enrolled as a student in a Uni as I have to finish my another Master thesis this Aug, so I think going back and apply for a student visa, I reckon they will grant my student visa. Come back, finish my Master and apply for PSW to get another 2 year to stay.
Any one know if this is possible?
