Maintenance requirements when applying for ILR

Post by faz123 » Mon Apr 13, 2009 8:24 am

Dear friends,
I would be grateful if you could kindly advise me about the maintenance requirements when applying for ILR on 4 year qualifying basis on HSMP.
I want to ask if we need to show £800 + 533 for each dependant for a total of 3 months in the bank account for ILR? (As required for Tier-1) or just proof of economic activity i.e >£2500 per month salary coming into the account and no recourse to public funds as it has been for HSMP applications in the past. I am on 1+4 HSMP visa and not on Tier-1. My problem is that I usually buy Premium bonds from my savings and I have not had a balance of £800+ 533 for the whole period of 3 months.
I would be grateful for your reply.
Many thanks

Faz123 I can clearly understand your fear but if you would be applying base on the JR judgement won last week I don't see any reason worrying about a new rule(Tier-1 or another). From what you have qouted above, I don't think they will affect the Hsmpians before April 3rd 2006.

All that is expected of you is that you showed you have been leaving in the UK for the past 4 years without recourse to public funds. And that you have extra savings, mortgage or whatever, all to your advantage anyway.

So no need to bother yourself about the new set of criteria, at least from all the information I have read in this forum and some other fora, you're sport on if you apply knowing that you have all your evidences to show that you have worked, pay you taxes and NO RECOURSE TO PUBLIC FUNDS.

I believe that by the time HO come out with their own new SET(O) form, it will be pretty moderate since they will want to fully comply with the judgement of the day.

I hope this submission will help you or any other experiences from you guys?

I would be grateful, if someone who has already applied and obtained ILR please let me know, if they had £800 + 533 for each dependant in their account for 3 months when the applied for ILR. Secondly, do we need to submit bank statements + payslips + P60 for the entire duration or would just payslips and P60 for the entire duration and bank statements for 12 months suffice?
Many thanks again

Hi Faz,
For applying ILR I don't think it says anywhere you have to show a particular amount of fund, bank statements plus pay slips and P60 should be enough.

Faz. i would suggest you have a look at the current SET(O) form which is the one that you would use for ILR together with the guidance notes this might answer a lot of your questions and put your mind at ease.

Thank you very much F2K and Herts for your reply. What I gather, the Maintenance Fund requirement is not for ILR- HSMP and you only need to provide proof of economic activity.
