claiming benefits whilst being a visa sponsor

Post by donnabrian » Wed Jul 01, 2009 1:16 pm

i am a british citizen and my fiancee is from mauritius, we r goin to mauritius to get married and then he will apply for a spouse visa to come to the uk. However I have a 6yr old daughter and can therefore only work 16hrs a week so am claiming tax credits. How will this affect me being a sponsor? as soon as we are married and come back to the uk I will be able to work full time as my husband will take over childcare so we will not be claiming any benefits.

You're entitled to benefits as you're a British citizen so it won't affect you as a sponsor.

It will certainly affect you potential spouse's ability to obtain a spousal visa.
It will be viewed as if you don't have enough resource to maintain yourself never mind your husband who will be coming to join you.

It will be in your best interest to sort out you finance before he proceeds with his application

If the OP has enough spare money (from the money she currently claims and earns) to support her spouse without claiming additional benefits then she should be ok.

You seem to be stalking me around here obie, please don't start trying to kiss me ok.

And it won't affect her spouse's application as she is, as a British citizen, entitled to benefits.
