Interesting. The article does not offer any evidence to support the assertion that they were sham marriages.

That’s why suspected sham marriages fell from more than 3,500 in 2004 to under 400 in 2008.
Hard to imagine it is only one per day in all of the UK.

If it was truely a sham, it is a good thing the arrests happened before the marriage!

It's such a shame that these chaps are continually making it difficult for all the genuine couples out there. I wonder how long before some new 'stricter' (than COA) rules are implemented before you can marry in the UK. Sooner or later, I think even the C of E 'loophole' will be closed, and you'll have to apply for COA regardless! Can't say I blame them (UKBA, I mean). :roll:

Interestingly non-EU family members of EU citizens residing in the UK are free of immigration controls, and so can marry without a COA.

Yeah, that's true. Guess it's in the spirit of non-EU family members enjoying the same rights as their EU ones. Pity it doesn't extend to spouses being able to travel alone within the EU without EU partner (according to some countries) even while holding a Residence Card, and instead having to apply for a schengen visa. :?

Not quite true, to become a family member in the first place you need to marry, so a person wishing to marry an EU national (such as myself) have to apply for the COA. Although it's free now, http://www.bia.homeoffice.gov.uk/siteco ... ificate-of

A number of family members of EU citizens can take advantage of this:
- Children

- Former spouses who have retained their rights to be considered an family member

It's very true! Ofcourse you first have to marry an EU national as a non EU national, thereby applying for a COA. But once you're married, the non EU dependants of the non EU spouse (eg children, siblings) who become family members of the EU national through the marriage ARE allowed to marry without the need to apply for a COA.

i just got my pr after a divorce.
but i dont understand all this even though it could benefit me, as i wish to marry an overstayer soon if it possible here .if not i would have to go to his home country.
which i wud love avoid if i can due to the expenses.

Bebe2, just a thought: Having read your post on acquiring PR after retention of rights following a divorce, wouldn't a "breather" be wise before taking the dive into another marriage?

i may have been divorced for months but how long have i been without a man?????????

how long can i keep my life on hold??
i want to put my past behind me and move as long as i have my loud laughter and an everyday smile, well i will be fine
