Sponsor for General Visit applicant while on DLA & Inc B

Post by dillys » Sun Aug 23, 2009 2:36 pm

I am a UK National and my husband is a Turkish National. My husband would like visit the UK as a tourist to see if he likes it here before we decide where to live - UK or Turkey.

Firstly, I didn't realise a general visit visa required a sponsor. Is this true or false?

If a sponsor is needed, is it possible to sponsor while claiming Disability living allowance & Incapacity Benefit?

Would appreciate any information anybody can give me, as I have read 6A, 6B and 6C and don't quite understand!

Regards,
D

Thanks for your quick response. My husband was actually turned down for his tourist visa on 14th August. In the Refusal notice, the ECO kept referring to me as his sponser and said no evidence was provided of my financial and accomodation status, as he would be staying with me and I would be providing food.

I wondered if providing a bank statement with my ingoing benefits would make the situation worse?

If you can prove that his presence in the UK, will not lead to you having to claim additional benefits, or that he has enough funds to maintain himself during his stay in the UK, he should be fine.

Remember, it is only when he is unable to provide evidence of adequate funds to provide for his essentials during his visit that he would need a sponsor.

Remember too a visitor with a wife in the UK is a red flag to an ECO, the assumption, right or wrong is that the visitor will not return and seek to switch to marriage visa in-country, which is expressly not allowed.

Thank you very much, you've really put my mind at rest. I will provide bank statements along with his appeal form and hope this settles the matter.

Thanks again!

Thanks for pointing that out, wanderer. I did wonder why there was such emphasis put on him not returning by the ECO.

My husband will definitely be returning to Turkey at the end of his visit, as we don't have the money for a Spousal or settlement visa yet. I have printouts of possible flights, but I was advised against booking in case his appeal takes too long, as we've now probably lost the £140 it cost to book his flight out. What kind of proof would be sufficient to an ECO to get rid of any doubt my husband would return? He works in Turkey and he did submit a letter from his employer saying when he needed to be back at work, property deeds as he owns a property in Turkey, Insurance papers to show he works there every summer. I can't think of what else could prove this.

Also, if it's expressly not allowed for someone to change their visa, why is it possible? Seems a bit daft to me!
