Hi all,

I would be grateful if someone on this forum can help me out with this query. I recently applied for ILR (work permit rules) along with my wife and baby (baby is born in England). Before the appointment with PEO office I made enquiries with UKBA office (email and phone) and was told that I don't need to apply for my babies FLR(O) visa, if I am applying for my own settlement, I can wait and apply for baby's Settlement with my application.

Whilst during the appointment things took another turn and immigration officer told me that this is not possible and rules have recently changed, meaning my baby do need a FLR(O) visa before settlement or can apply for settlement as a individual applicant paying full fee. Me and the wife got ILR and were told to get another appointment for baby.

When I rang UKBA next day they said there isn't any such rule and my baby's visa has not been considered on unfair grounds and by a mistake. They said I am not the only one and it has happened to other people. I was told further that they will investigate and get back to me.

Its been 3 weeks now and nothing heard, I want to know, where I stand on this, what can I do? offcourse I want to sort out my baby's visa ASAP as I have travel plans. Understandably I don't want to pay another £1020 for baby's visa when this has been not granted due to UKBA error.

Any advise would be much appreciated.

Your posted link re-iterates my view in original post that UKBA basically made a massive mistake.

Has anyone else had this situation??? if not if someone has faced similar sort of issue on any visa type,

what can be done from my side??? whom can i contact ??, does this fall under complaints category??

Guys, please make this thread sticky (if possible) because we need to keep an eye on the homeoffice's approach on this.

You could forget the whole ILR thing and apply for you baby to be registered as a British Citizen straight away
