Refusal of resident card for Non EU spouse of EU citizen.

Under Regulation 3(2) it is required that in order to avail of residency rights in the State (Ireland), the applicants must submit evidence showing lawful residence in another EU Member State prior to arrival in Ireland.

From what i red here, Ireland denied many applications for EU4FAM Residence card.


I am a Non EU spouse of EU citizen. Can someone please explain to me if the above practice is still in place in Ireland or has it been abolished.
I would also appreciate if you may add a link that will elaborate further.

That stupid law was no longer operating in ireland,was smashed by the European court of Appeal under metock ruling july 2008.Every past cases that fall under this directives were reviewed and lots were granted 5 years Eufam. Check the immigration web sites for more details and contact your lawyer, never too late for you.

Thats old thing but the new thing is these days they have started once you get you approval letter and when you will go to get stamp on your passport they start taking interview.
yesterday one of my friend went for student extension and he met an Indian guy over there the guy was married to Latvian and his application was approved and later immigration officer didn't stamp his passport and he kept the approval letter. He said we will write you a letter when we want to see you again.
This is stupid.

This shit law is gone in 2008.

That law was revoked due to the scum in Brussels interference. Pity.

That section of Statutory Instrument 656 of 2006 was deemed unlawful, as it was incompatible with EU Directive 2004/38/EC - a directive which Ireland, together with every other Member State of the EU, is obliged to correctly transpose.
