ARC card and removal

Post by worriedwoman » Wed Mar 31, 2010 11:29 am

Boyfriend was issued with ARC last Monday and has to report to an immigration official next Tuesday (Then he'll be told when he has to report next). I am 6 months pregnant, with EU passport and ILR since 2003, working. In the letter wich came with the ARC card, it says my Boyf. is liable to be detained.
My question is: shall we submit evidence of my pregnancy in order to try and prevent his detention/deportation? He has applied for his status in 2007, but his doc. were mixed up with somebody else's by the HO, and only untangled last Monday! We have a letter from the HO, where they admit identity mix-up and apologise for long delay. Boyf worked for the same company for the last 7 years (he was given work permit on his previous leave), but on Monday was issued with ARC with "Employment forbiden" writen accross it.
Is it worth writing a letter to the HO explaining situation (pregnancy) and asking to take this into consideration, when deciding his case? Can I cite Rights to a family life or Human Rights?
We are planning to do all the paperwork ourselves, as a solicitor we've employed earlier wants only money- I would rather spend it on my baby, especially, that I am the only one able to work (not for long, though!) at the moment.
Could not sleep last night, as I was thinking about next Tuesday, or any other "Reporting Days", when my Boyf will be arrested and detained/deported, and I will be left here pregnant or holding a newborn in my arms :(

All asylum seekers are liable to be detained. Only pregnant women in advanced stages of pregnancy are exempt. Unfortunately, that is the one of the prices they pay for claiming asylum. What does your solicitor say?

When they interview him, he will be given an opportunity to give any other reasons as to why he should be allowed to stay in the UK so not sure whether or not your letter will actually be taken into consideration. It is at this stage that he has to mention any other mitigating circumstances and provide proof of said circumstances for them to give consideration to them. Why would the solicitor want money on an asylum case? Where you not assessed for legal aid.
