Child Benefit and Naturalisation

Post by doesnotcompute » Wed Jul 21, 2010 4:00 pm

Hi, I'm an Irish national excercising my Treaty Rights in the UK. My wife is South American, and we are planning on moving back to Ireland and using the Surinder Singh ruling (i.e. apply for a Stamp 4Eufam for her on arrival in the State).

If we have a child in the UK, and we subsequently apply for Child Benefit when we arrive in Ireland, will this have a negative impact on her chances of getting naturalisation later on down the line?

Also, would the child be entitled to British citizenship? I believe that since I am an Irish national, I have "settled" status in the UK, therefore the child would be entitled to British citizenship by birth (or am I wrong)?

I can't answer the question about Irish Naturalisation, but as regards the status of the born-in-the-UK child, you are right and Irish citizens automatically have "settled status" in the UK, and that being the case your child will be British from the moment of birth. He/she can also no doubt have Irish Citizenship, and possibly citizenship of mother's country as well.

Child benefit will not affect naturalisation.

Jobseekers benefit/allowance would affect it.

Wouldn't it be simpler for her to get her British citizenship first, unless there is a strong reason for her not to?

The child would be a British citizen.

I am in the UK as the nature of my job requires me to be here. I am being sent back to Ireland before she can apply for British naturalisation.
