Visa status of child born to Tier1 General father

Visa status of child born to Tier1 General father

Hi all,

I have searched through the forum posts to figure out the answer of my query as stated in the subject line however I couldn't find a post which could answer my query

What will be the visa status of a child who is born in the uk to a tier1 general visa holder father? The visa status of father is going to change from tier1 general to ILR next month.

Will the child be eligible to apply for a British passport or he should apply for the passport of the home country of parents and get tier1 general dependent visa linked to the fathers visa?

Kindly advise?

1. If a visa is to be applied for, then the immigration status of a child born to parent(s) with temporary leave to enter / remain is that of a dependent.
2. Child born in the UK to parent(s) with limited leave to enter / remain does not require a visa to remain in the UK or exit UK, but needs one to enter UK.
3. After either parent is granted settlement, the UK-born-child is entitled to register for British citizenship (Section 1(3)), irrespective of child's immigration status.
4. If you wish the child to possess a passport of the country of current citizenship before the child is registered as a British citizen, you may apply for one. Your choice!
