Your employment status is of no interest, only the EEA citizen's status counts. If your wife was working continuously for all 5 years since you got married, you can apply for permanent residence from December 2011.racim wrote:hey everyone
i heard that i can apply for my PR resident from dec 2011 , would that be an issue because i didnt start working till when i got my 5 resident but my wife she was working.
This should be no issue if you apply in December 2011. Your application should be decided in less than 6 months, so your wife can renew her passport once UKBA has returned it to her.racim wrote:my wife passport will be experied in july2012
thx for your replay Stefan-TRIf your wife stopped working voluntarily for an extended period where she solely relied on your income, she could have only exercised treaty rights as a self-sufficient person during that time. Should this be the case, you have to show a Comprehensive Sickness Cover (health insurance) that covers both of you for such periods.

what happened if you divorce now? have you try to save your marriage first?
if you divorced now you cannot apply for pr but for retention of rights if you want and apply for pr at a later stage.
