advise needed plz

hey everyone
i got married in dec 2006 with an EEA member , note that i am not an EEA member.
i got my 5 resident in aug 2007 it will be experied in aug 2012.
i heard that i can apply for my PR resident from dec 2011 , would that be an issue because i didnt start working till when i got my 5 resident but my wife she was working.
my wife passport will be experied in july2012 would HO ask me for new 1 , or shall i just submit my application with that one in dec 2011 !!!

Your employment status is of no interest, only the EEA citizen's status counts. If your wife was working continuously for all 5 years since you got married, you can apply for permanent residence from December 2011.

If your wife stopped working voluntarily for an extended period where she solely relied on your income, she could have only exercised treaty rights as a self-sufficient person during that time. Should this be the case, you have to show a Comprehensive Sickness Cover (health insurance) that covers both of you for such periods.

This should be no issue if you apply in December 2011. Your application should be decided in less than 6 months, so your wife can renew her passport once UKBA has returned it to her.

An EEA worker will not need separate health insurance cover.

Hi there
I have been told that i can apply for my PR resident in December 2011 , there is something that I am confuse about it my 5 resident will finish in aug 2012 but I got married in dec 2006 my marriage certificate is from abroad my home country That's the 1 I submit to get my resident . Would that be fine if I submit my application in nov 2011 !!

Me an my wife we not gettin on well recently.wot if I apply for divorce now, coz she decide to help me 2 get my PR anyway , can I submit my application with her supportin document and without providing the HO divorce certificate ,wouldn't the HO find out that I am divorced by law.

the clock for your pr start from the day you have been living with your wife in uk and that she was exercising her treaty rights from that date.
what happened if you divorce now? have you try to save your marriage first?
if you divorced now you cannot apply for pr but for retention of rights if you want and apply for pr at a later stage.

Well I came 2 uk on visitor visa in july2004 I over stay ,I started 2 live with my wife in the beginning of 2006 , I got my marriage certificate from my home country dec2006 , I apply for my RC straightway and got it in aug2007 ,it will exp in aug2012.
I am not divorced yet but we both agreed for that but my wife she wants to process it now , but she said she can help me till when I apply for my PR.
I mean if we get divorced and the certificate will be issued before I apply for my PR can I apply to HO without submitin divorce certificate is like we still 2gether !! Can the HO find out that we been divorce by law

it does not matter where you married as long as you have a proof that you was in uk in dec 2006 , living with your wife and she was exercising her treaty rights you can apply for pr in dec 2011. as far as telling the ho that you have divorced it is a personal decision. if you have all the evidence why wouldn't you tell them you have been married for at least 3 years of marriage so you should be fine. please read my history because i divorced and i informed the ho and was granted pr.
