Hi,

My visa got rejected under 320(1) because of below reason
I had applied for dependant visa on (date).I had planned to visit my wife and leave my son with her under a day care center as i had only two weeks of leave from my employer. You were not satisfied on the balance of probabilities,that we meet all of the requirements of immigration rules.


Re applying now,
Giving justification for rejection following way, could someone please correct me that my approach is correct.

My son who is only 1.5 yr old desperately requires his mother's care and both of our love and affection. Now,I have taken long leave approval from my employer(28th April 2011 to 3rd Jan 2012) to join my wife along with my son.

My wife's work assignment gets completed in Dec(30-12-2011) and we all three of us would return together.

My approved leave letter from my employer and Deputation letter from my wife's employer is enclosed as a supporting document.

Unless the exact reason(s) of refusal of earlier application are clearly known and understood, it is difficult to suggest whether or not your "approach" will work this time around.

Please post what the refusal letter states regarding reason(s) of refusal. Paste content in verbatim (excluding any personal details).

Hi sushdmehta,I have explained as u suggested.

The contents of my previous sponsor letter was as below.

my son would be with me till my visa period in the UK under a day care center, but my Husband will be visiting me on short visits subject to his leave approval as he is placed in X company Limited, a MNC at Chennai.

The Refusal letter from british high commision are as below.

I have also taken into account the conlents of the letter from your spouse where she clearly states: 'my son would be with me till my visa period in the UK under a day care centre, but my husband will be visiting ....,. as he is placed in x company. ..".

I am not satisfied that entry is being sought for a purpose covered by the lmmigration Rules. 320(1).

I have therefore refused your application because I am not satisfied, on the balance of probabilities, that you meei all ofthe requircments ofthe above paragraph(s) of the lmmigration Rules.

On getting through the refusal letter with various solicitors,the reasons for refusal as follows

1.Purpose of dependant visa is joining together and not visiting (which is for visit visa purpose)
2.If We mention that child will be in day care,then supporting documents for the same should be furnished.
3.As per UK immigration,Child should be with both the parents.It does not accept child with single parent.


Now am Planning to re-apply with the below Reason and as explained in my initial post.

As per your other post, this doesn't seem to be the case.

IMHO, you are still "visiting" your wife and the ECO may have the same opinion. The fact that you are employed in home country and may be able to provide evidence of "fixed term leave" from the employer is proof enough for the ECO to know that you do not intend to "join your spouse" in the UK to live there.
