visitor visa for daughter - myself on tier 2 general

Post by esal » Thu May 19, 2011 4:29 pm

Hi,

I am on tier 2 general visa from Feb 2010.

Had a baby daughter in India and would like to know if she can come on visitor visa instead of dependent visa.

Reason - dependent visa going to cost 30,000 rupees from India and I am looking forward to change job soon. If I get new sponsor then I assume will have to again apply for new dependent visa for daughter and will have to pay again huge fees.

Is it possible to bring daughter on visitor visa and then from here(UK) apply for dependent visa?

many thanks

If both parents have leave as PBS migrants (main + dependant), then it is nearly impossible that the child will be granted entry clearance as a visitor.

And, visitors cannot switch to PBS category.

Just to add to that - you will have to prove strong ties that the child will return within six months. The fact that a parent is here is what would make it exceptionally difficult to prove.

thanks sushdmehta and mulderpf.

It does make sense to what you both said.

Another query is - If a bring daughetr on tier 2 dependent visa, and then if I change job in a couple of months then do I have to send her and my wife's application again with mine?

thanks!

If not travelling outside CTA before their leave runs out, I believe they may continue living in the UK on the current Tier 2 leave and apply for extension before expiry of current leave.

Do check with UKBA.

I'm not sure that they would even need to change if they were travelling outside the CTA, the dependents have been granted leave as dependents of a tier 2 migrant, if the tier 2 migrant then changes employer, the purpose of the dependent's stay in the UK is still the same, therefore I don't think they would need to extend their leave.

Again many thanks to sushdmehta and Greenie!

I will surely check with HO but your replies gave me a good instant relief and hope, as I was worried to pay again dependent fees for wife and daughter's visa.

Last time I called ho, spent 30 mins to get through someone on the line then the guy told me to refer to HO website as he didn't know much info :(

many thanks
