Hi,

My partner is South African and is into his 3rd year on an ancestrol visa, i am a british citizen with 2 children and am expecting a 3rd which is his, i recieve income support, DLA, child tax credit and child benefit and the housing benefits. We want to move in together and know the finances will change...on his visa it says no recourse to public funds....does this mean we as a couple can/can't claim tax credits.... your help will undoubtly stop my brain from hurting from trying to find out....no help from the local tax office :( [/b]

Hi! i know its been a while since you posted it, but was wondering if you now had the answer?? I am British and my husband is here on an UK Ancestry visa and has been for 4 years now. Since being on it, we have had 2 children and I have been claiming child tax credits. Ofcourse, because he is my husband and lives with me, his income has also gone onto the application for for the tax credits. but i am the main applicant and the funds go into my account. Just looking at applying for his indefinite leave, i see it can affect it? does it? what was your outcome?

Child benefit can be claimed in your name (British citizen) only. Child tax credits MUST be claimed in joint names with your partner.

It will have no effect on the ILR application when he qualifies with 5 years residence.
