Job dilemma - can employer ask candidate to pay WP fee

Post by rg1 » Fri Aug 04, 2006 8:49 am

I'm currently on WP. Recently I got a offer from a company. They said as per their policy they don't sponsor WP. But they can provide me all documents necessary to submit my WP change of employer application but I need to pay the fee myself.

Is it quite common incident or something awkward?

The company is medium sized (>200 employees) and salary offer is not bad though.

There is no such thing as a work permit change of employer application. Any new employer will have to submit a brand new work permit application on your behalf. You cannot do it yourself, it is your employer who has to do it.

If they don't sponsor work permits then you're out of luck because that is the only way you will get one from them.

With regard the fee, as long as a valid form of payment is received with the work permit application, the arrangements over who ultimately pays for the application is a private matter between the employer and employee. There is nothing stopping the employer from asking you to pay for the application as a condition of employment.

See the Work Permit FAQ:

The new employer is ready to "sponsor" the WP application. The change of employer is same as new WP application but extempted from the 3-month candidate search requirement.

All they asked me to pay the fee as it is not their policy to pay the WP fee.

The exemption from a recruitment search only applies if your job title remains the same in your new job. Good luck!

yes you can... I was also in the same boat 3 yrs back... I filled the application form and fees. And the company provided all the necessary documents... And I got my WP...

But the WP application has to be signed by somebody senior in the company....

That's good, my job title remains nearly the same.

I was just wondering if they can pay good salary why they can't pay WP fee!

look at this way, who's in need now and you say they are offering you good salary... look at the long term benefits...
