Looking for advice

Post by Crozier » Wed Jul 27, 2011 1:02 pm

Hi all,

I was hoping somebody could help me out with some advice. My wift is from Hong Kong, I am Irish, and we have been married now for 3 years. I know that she is now eligible to apply for naturlisation, but we also have her daughter from Hong Kong living with us now for the past year. My question is, will my wife be able to apply for naturalisation for her daughter at the same time as for herself?

Also, I see one of the conditions for naturalisation is that you are self-supporting. My wife has not been able to find a job since we got married, is this going to affect her application for naturalisation?

Thanks in advance,
Crozier

Hello Crozier. Welcome.

I believe the mother needs to naturalise first, then an application on behalf of the daughter can be made by the naturalised mother. Presumably the daughter is under 18.

As long as you're support them and your wife is not in receipt of social welfare (child benefit excepted), she'll be grand.

Thank for the reply Ben. My wife has actually been receiving job seeker allowance (a very minimal amount as its means tested against my own wages). Is this likely to be a big problem?

Thanks again,
Crozier

I presume her daughter is under 18 yo.
Check Form9 - she must be present in state (Ireland) for 3 years before applying.

I'm not certain. It's controversial. Some people say it matters, some people say it doesn't. It's not defined in law either way. Bit of a grey area. But hey, this is Ireland. ;)

In case of spouse to Irish citizen do you have to complete the full Form8 or just the "APPLICATION BASED ON MARRIAGE TO AN IRISH CITIZEN" Part.

In case of full application they have asked about social payments in Question 10.3.

I'm not sure Pikka, I'll check it out and see.

Thanks for all your replies. Kinda worried about the social welfare now though :?

I have checked the form, are we not supposed to fill in the form from the beginning? Is it possible to just go straight to section 14- "application based on marriage to an Irish citizen"?

Thanks,

The answer of this question can only be given by those who applied based on marriage to Irish Citizen, is there anyone available to answer this question please?

The FULL FORM needs to be completed, check the list of supporting docs required in the explanatory notes. Three proofs of address for each spouse for each of the preceeding years (including this one).
