Is the card on the list of things you need to send in?

I would write a cover letter explaining why do not have it and send in the application. It was issued by UKBA in the first place, so they know exactly the information on it. I do not see how it could be "required" to have physically.

I was going to comment on this about the WRS being scrapped, but I went and read the EEA guidance and it says for EEA4

If you are applying for a permanent residence card and your continuous 5-year period of residence in the UK in accordance with the regulations includes a period when your EEA national family member was required to be registered on WRS then you must provide evidence of this as stated in section 10. If you cannot show that they were registered as required then you will not be issued a permanent residence card.

Of course there might be some flexibility because on the front of the form it says the form doesn't have to be completed but it makes it easier if it is. Plus as said, if she was registered with the home office they should ideally have a record of this...ideally.

You can find the form here: EEA4 application form

Do you have a photocopy or photo of the WRS?

If they give you a problem, you could always appeal. And you can always order the EU citizens SAR from the home office, which will detail it: http://www.ukba.homeoffice.gov.uk/navig ... onal-data/

Ask you sponsor to confirm in writing that they have lost your certificate.

Vinny, the certificate is the EEA national's, not the OP's. Its loss would theoretically prevent even the EEA national from getting an RC from the Home Office.

Actually a EEA national can not get an RC in any case.

But more generally: No way!

It is a simple document, and there are archives and computer records in UKBA to show that it has been applied for and processed. Citizens of only two countries are now required to apply for one, and the lost/theft of can have no legal bearing on their right to stay nor the right of the family member to stay.

It can cause hassle though!
