Hi,
First of all many thanks for such a wonderful forum, it really helps one to get everything needed to apply for ILR.
My query:
Date of Entry with WP on 10th April 2006
Date of leaving to India to work for same Indian company 01st Nov 2006
Date of return with same WP on 10th Feb 2007 (Entering UK after 100 days gap)
Date of HSMP visa granted 13th Feb 2008
Date of Tier 1 visa granted 20th Jan 2010 valid until 2013
Can Moderators please let me know when can I apply for my ILR?
I have already cleared my LIUK test this month.
Looking forward to get some useful advice.

I think you can apply anytime after mid of Jan 2012, as long as it is within 28 days of your 2nd entry (10th Feb).
Your case is straightforward and since you have visa till 2013, it gives you flexibilty to apply even a little later. You can just disregard your initial stay.

Many thanks for the reply. Does this means that I can give 10th Feb 2007 as Date of UK entry for my ILR 5 years.

This is a technical question, not very sure what date you should specify.
In my opinion the Date of Entry into UK should be the original date, i.e. 10th Apr 2006. But you are qualifying based on your last 5 years continuous stay starting 10th Feb. And to prove that you may supply documents like last 5 P60s.

Hi, Can someone advice please.
My situation is:
1. First came to UK as student dependent/spouse in October 2002. Visa valid until December 2007.
2. In January 2007, received WP but had to go back to home country to switch catergory. When home and seek entry clearance, granted 22nd March 2007 until 22nd December 2009. Arrive back in UK, on the 27th March 2007.
3. Apply extension, but had to change to Tier 2 (Senior Care Worker) in Dec 2009 and received extension Tier 2 until 22nd Dec 2011.
4. Apply extension Tier 2, attended biometric and recently granted FLR until 22nd August 2013.
From December 2003 (whilst still dependent) I have been working with the same company.
My husband and children are all under spouse/dependent but ony switch to this catergory in November 2007.
My question is:
1. When would I be able to apply for ILR?
2. Would I be able to apply in person first and husband and children later, through post?
3. What would the best option be as husband came as student in May 2002, can he apply for 10 years long residence ?
Thank you for your kind cooperation.

1. You may
apply for
ILR from
Tuesday, 28 February 2012.
2. If husband and children are your
dependants, then they may be included with your application.
3. Possible too.

Can someone please let me know what date needs to be given on SET(O) form as UK entry date, whether its 10th April 2006 or 10th Feb 2007?

Thank you for the help Vinny.
Just to clarify, is it possible if I apply in person at PEO in March, and once granted, my husband and children to apply through post as spouse/dependant of a person who have Ilr. Will this way be more cost effective?
Thank you again.

If husband does not apply at the same time as the main applicant (
319E(b)), then he may be expected to
switch prior to applying for
ILR (
287(a)(i)(d)).

Can some guide me what should be date to be mentioned in UK Date of First Entry and absences since then?
Should I mention 10th April 2006 as date of first entry and provide absences from my second visit? or mention all the absence since my first visit for past 5 years and 9 months (which comes around 216 days including my first gap of 100 days)
I am really confused and require help ..........please help

thanks again Vinny.
sorry... but Im a little confuse here.
just to clarify a bit more.... I have 5 children and my eldest son is turning 18 in April and 2 of my youngest children (age 7 and 3) were born in the UK.
reason why I wanted to apply PEO Ilr is so that I can include my son before he turn 18 but if I apply PEO Ilr for all 7 of us, its going to be really expensive.
can you kindly advice what would be most cost effective.
really appreciate your time Vinny, thanks again.

They
do not need to apply for ILR.

I think that you may apply for
ILR from
Friday, 13 January 2012.

Can you advice please vinny,
Do you know if the senior health care assistant have been removed from code of practice? if it has, and I was previously granted on that cop, would my employer still be able to write that on the support letter as we cannot find anything else that match the job role and salary.
Thank you
