Work permit dependent visa was refused, help please

Post by rs1249 » Fri Oct 07, 2011 12:01 am

I have a five years work permit visa which has period from 1st Nov 2007 to 31 Oct 2012. On 30th march 2011, I was trying to apply my two years old son's work permit dependent visa. I applied through my lawyer, and give them all the documents they required. It suppose to be straight forward case, but later the UKBA refused the my son's dependent visas saying my work permit visa expires on 27th August 2007, and there is no rights of apeal and said all paper works has been forwarded to the local enforcement office.
The reason for the refusal was utterly ridiculous, well, for the start, no where on my passport has a visa expires on 27th August 2007, I don't know where they got that date from and for second, I applied my wife's work permit dependent visa to 31 Oct 2012 back in 2008, and that was totally fine, why on earth they refuse my son's visa.

what should I do now cos I don't have right of appeal according to the letter. and I can't even get my passport back, and next year, I need to apply for settlement visa, and I am worried they may invalidate my current work permit visa. I have written to them to ask them to review the case, and so far, five months has passed, and no reply from them at all. My lawyer doesn't want me to make a court case, saying there no need for such obvious wrong decision, asking a review will do, but I am worried if I don't take action now, the waiting list for court hearing may be several month, and I may even miss the expire date for my current work permit visa which may cause added complicate when I apply for settlement visa.

Can someone give me some suggestion please!!! This is really stressful.

This is serious. you deserve an explanation.
Take these guys to court and CLAIM compensation (since they hv yo passport, you can argue that you are not able to travel now-thus being deprived of a lot of thisngs, freedom, rights to movement) try to quantify your loses and ask a lawyer to set a good figure.
You can make yourself some money out of this. What they have done is illegal.
Let us know how this puns out

Do you have any suggestion of good lawyers who can deal this kind of case?

perhaps there is something you are not telling us. You could have gooten this sorted a long time back. If it was ukba's fault it should have been fixed within a few days after your reported the error.
Why did you apply thru a lawyer for such a straight forward case?
Why are they saying no appeal rights?
Why immediate enforcement (removal procedures)?

I am begining to think that your work permit was cancelled after you had broken/flouted its terms (probably by changing employer without re-applying to ukba etc)
you certainly know you have some rotten tommatoes hidden.

you can never get appropriate and useful help if you dont come clean with you problem.
If my suspicion is correct, and if you had come out, I might have been able to help because I know someone who was in a similar situation who we worked together to resolve the issue and were granted new Tier 2 visa.

Note that if child was born in the UK, then child does not need to apply for leave to remain.
