Tier 2 ICT switch to Tier 2 General \ ILR \ Tier 2 Extension

Post by vai78 » Sun Nov 24, 2013 12:54 pm

Hi, I am in UK since July 2010. I have been granted 3 years VISA in July'2010 under "Tier 2 (Intra-company transfer - Established staff)" category. Then recently my sponsored company applied for extension of 2 years under "Tier 2 (Intra-company transfer - Long-term staff)" in May’1013 and now my VISA is valid till June'2015.

I have three queries as below:
1. Do I still eligible to switch to "Tier2 General " category if I have job offer from different Sponsor?
2. Is it possible for me to apply for further extension to stay in UK after my VISA expires in June'2015 or I need to return and can not re-apply for 12 months cooling period.
3. Do I still eligible for ILR?

Please provide me help on above 3 queries.

Hi, I am in UK since Oct'2010. I was granted 1 Year VISA in Oct'2010 under "Tier 2 (Intra-company transfer - Established staff)" category. From then on I have been in UK as my company applies Visa every year under "Tier 2 (Intra-company transfer - Long-term staff)" now my VISA is valid till Oct'2015.

I am planning to switch to "Tier2 General " as i have a job offer from different Sponsor?

My question is will I have any eligibility of ILR?

yes, 5 years after you switched to T2G but not if you remain on T2 ICT

you can extend your T2 ICT visa indefinitely in-country provided you have a CoS for each extension

you will not be eligible for ILR if you remain on T2 ICT, only if you switch to T2G (5 years after the switch)
Please provide me help on above 3 queries.

Hi manci

Thanks a lot for quick response, that was a much valued answers for me personally to decide my future course of action.

I have another very quick question.

For switching from my current visa category to Tier 2 General, can I do it within UK or do I need to go back India (where i came from) and apply from there?

If I need to go back does cool off period applies to me??

Any exception to the general rule that a tier 2 ict Visa holders can not apply for ilr? If yes then what are the common/acceptable grounds for that?

This topic is more than 2 years old. Please refrain from digging up old threads.

ICT issued after April 2010 DOES NOT lead to ILR, no exceptions. Suggest start your own topic with your circumstances and perhaps read the forum T&Cs.
