openning a Ltd company in UK on Visit Visa

Post by Tire1Questions » Fri Nov 29, 2013 10:27 pm

Hello All,
Does anybody know if one can open a Limited Company in UK while in UK on a business/visit visa?
Is it legal? If it is legal, can I get the reference anywhere on HMRC or HOme Office website?

It is and it isn't. Depends on which stream of law you look into.

As far as company law is concerned, it is fine.

Looking at immigration law, it is regarded as trying to indulge in activities you are not supposed to indulge while on visit visas.

Many student extensions have been refused in past because of registering companies.

I would say, don't do it.

Thanks for your reply.
I am looking at it from immigration stream of law.
I have just re-checked: the visa he holds is "C-Visit - Business" and its not simple visit visa.
Is it still advisable not to register a Ltd company in UK?
He is more concerned from Home Office point of view as he does not wish to breach the law.

C -visit business is just a simple visit visa, nothing else.

I have already cleary mentioned the position.

Thanks for your reply. Can someone else also confirm what Ayyubi72 said?

Today I talked to a lawyer from London and she confirmed that it is alright to open a company on C Visit visa????? I specificially mentined to her "would it not violate immigration law" and her answer was no.

I am really confused. ( I know there are some lawyers out there who do not keep themself up-to-date with law!!!!

I would say this lawyer has not the slightest idea about immigration law.

But if you insist on keep asking until you hear what you want to hear, then I will spare you the misery.

Tell your friend "do it" Get a company regsitered. Whatever happens later will happen. And yes, also tell your friend that when he applies for visa next time, he should mention in the application form that he has a limited company registered in UK. Also tell him to include the original certificate of incorporation. That will get him the next visa super fast.

I appreciate your quick reply.

No, its not what I want to hear. I am just trying to verify contrary info I received from two different sources. And there is no harm in it. Thats why we are on this forum-'to learn'. And this is the beauty of it.

I do not think, if there is anything I did to offend you. But, if by any chance you feel offended, I am sorry for that.
But I would still welcome other senior members comment on it!
