Tier 2 ICT - Long Term

Hi

I got T2 ICT LT issued this year on 31-Jan-13, entered UK on 1st March-13. This is for 3 years and valid till Jan-2016.

As per the current rules (a bit confusing), can I apply for extension with the same employer from within the UK?
(I believe, I read 2 years extension is allowed, but unable to confirm)

Will the 3+2=5 years could towards ILR assuming all else stays the same?

Sure thanks.

I believe, Tier 2 ICT is linked to the employer and I will need to change visa if, I were to change employment.

Which visa category will I need to change to with the new employer?

Can I do it while I am in UK? or do I need to go back to my passport country?

If I need to go back, does the 12 month cool-off period apply?

sorry, I missed that you are on T2 ICT and not on T2G.

remaining with the same T2 ICT employer, and provided they give you a new CoS, the max length of extension is 2 years and the max stay in the UK is 5 years.

You cannot change employment and switch to T2G in the UK but have to return to your home country and once you have a CoS apply for entry clearance after the 1 year cooling-off period has passed

Hi, no worries. I thought so.

Do you see a challenge in getting ILR after 5 years of stay in this case?

Rules might change 5 times till then, but trying to understand the implication as of now!

no crystal ball, but under present rules after 5 years continuous and lawful stay on T2G one becomes eligible for ILR. Note the £35k salary threshold from 2016.

"Manci - I thought that the T2 ICT route to ILR had been closed if the visa did not include time as T2 ICT issued before April 2010, per extract below :
245GF. Requirements for indefinite leave to remain

To qualify for indefinite leave to remain as a Tier 2 (Intra-Company Transfer) Migrant, an applicant must meet the requirements listed below. If the applicant meets these requirements, indefinite leave to remain will be granted. if the applicant does not meet these requirements, the application will be refused.

Requirements:

(a) DELETED

(b) The applicant must not fall for refusal under the general grounds for refusal, and must not be an illegal entrant.

(c) The applicant must have spent a continuous period of 5 years lawfully in the UK, of which the most recent period must have been spent with leave as a Tier 2 (Intra-Company Transfer) Migrant, in any combination of the following categories:

(i) as a Tier 2 (Intra-Company Transfer) Migrant,

(ii) as a Qualifying Work Permit Holder, or

(iii) as a representative of an overseas Business.

(d) The continuous period of 5 years referred to in paragraph (c) must include a period of leave as:

(i) a Tier 2 (Intra-Company Transfer) Migrant granted under the Rules in place before 6 April 2010, or

(ii) a Qualifying Work Permit Holder, provided that the work permit was granted because the applicant was the subject of an Intra-Company Transfer.

Hi Manci -

I read on a different thread that T2 ICT Long Term to T2G switch is possible without the cool-off period, if the salary is £152,000+.

1. Can you confirm this?
2. Can you confirm that this can be done from within UK?
