Kindly help me. A friend of mine is applying for spouse visa from abroad. His wife earns 300 - 390 Pounds per week working for the same employer more than 5 years. So they intend to use category A. ( in employment and working for the same employer more than six months), but she will be a bit short of the required 18,600 Pounds and they will top up the shortfall by a cash savings held in the name of the applicant which was held more than six months. That should be straight forward so far.
The confusion is that she has been sick during the month of November 2013 and was paid a payment of 98 Pounds of what is written in her payslip as 'statutory sick leave payment'. Now in the worked example in the Financial requirements appendix in the home office web site they used a person who took 2 weeks unpaid sick leave during the six months prior to the date of application and disregarded that 2 weeks without payment. So they considered that the unpaid sick leave period will not break her employment but the applicant had to provide payslips for 6 months and 2 weeks instead of 6 months to cover for the sick leave period.
Here she was not working for those 4 weeks and her payslip does not show any other payment apart from that sick leave payment. The question is does she need to provide six months payment excluding the November month (the 7 months preceding he application date disregarding November) or is that 98 Pounds considered payment and all her income for the six months period is to be calculated using the lowest payment which will be then the 98 Pounds?
