Help in Calculating Financial Requirement in Spouse visa

Post by Alos » Tue Jan 14, 2014 5:46 pm

Kindly help me. A friend of mine is applying for spouse visa from abroad. His wife earns 300 - 390 Pounds per week working for the same employer more than 5 years. So they intend to use category A. ( in employment and working for the same employer more than six months), but she will be a bit short of the required 18,600 Pounds and they will top up the shortfall by a cash savings held in the name of the applicant which was held more than six months. That should be straight forward so far.

The confusion is that she has been sick during the month of November 2013 and was paid a payment of 98 Pounds of what is written in her payslip as 'statutory sick leave payment'. Now in the worked example in the Financial requirements appendix in the home office web site they used a person who took 2 weeks unpaid sick leave during the six months prior to the date of application and disregarded that 2 weeks without payment. So they considered that the unpaid sick leave period will not break her employment but the applicant had to provide payslips for 6 months and 2 weeks instead of 6 months to cover for the sick leave period.

Here she was not working for those 4 weeks and her payslip does not show any other payment apart from that sick leave payment. The question is does she need to provide six months payment excluding the November month (the 7 months preceding he application date disregarding November) or is that 98 Pounds considered payment and all her income for the six months period is to be calculated using the lowest payment which will be then the 98 Pounds?

Many thanks

Is she in salaried or non-salaried employment?
Non-salaried (i.e per hour) she would just work the extra weeks she was off sick, as you mentioned, and she would need have earned an average of £9300 prior to the application for Cat A.
Salaried she would need to show she received statutory sick pay and evidenced in bank statements and a letter from employer.

I am not quite sure if she is in salaried or non-salaried employment. Honestly I don't know the difference. She has been employed by the same employer over 5 years and she is paid 7.5 Pounds per hour in a 40 hours per week which is the 300 Pounds and she is entitled to 21 days holiday per year. Any extra hours she works during the week is overtime and paid accordingly.

And assuming that she is in non-salaried employment why did you say she needs to have earned an average of 9300 Pounds? How would that cover for the 18,600 Pounds required for the spouse visa? Is that 9300 Pounds weekly, monthly or annually?

Many thanks

Sounds as though she is non-salaried but given her current situation it would be in her best interests to look through the details and see if that does apply to her.

The reason I said 9,300 is because that's what needs to be earned over 6 months to qualify... that is equivalent to 18,600 for 12 months
