Help ! ILR form set M without UK test yet done

Good Afternoon,

I am seeking some general advice,

My question relates to an application for ILR. My wifes visa is about to expire (15th Feb)

We were in the process of filling in the ILR form set M.

We notice that one of the requirements is to take a life in the UK test.

The earliest date we can find is the week commencing the 25th Feb.

Is it possible to submit the Set M ILR form with a letter explaining that the test result will follow, as we can't get a place before this date ?

Or will the application be refused because of its omission ? Or will they take a view. The last application was refused as we didnt provide a formal language test, bust was given discretional approval. There is no issue as her English is better than mine, however, the current visa runs out next Sat, so we need to move one way or another.

If so, what is the best way forward.

Have you tried to book at any of the other test centres to get an earlier date?

She also needs English Language to level B1 test certificate for ILR application.

Apparently the results take 7 days, so timescale looks relly prohibitive. That other test you mentioned was the one that was the reason why the last visa was initially rejected, but then at the bottom of the letter given as an exception and as they stated, outside of standard rules.

She will have been In the uk for 10 years in April, from student visa, then visitor visa followed by the spouse via that is soon to expire.

you can send the results later.
but you need some ID to write the test, hope you have something else other than passport

A quick google search said no test, application rejected ! But perhaps if on the application for ILR we show the test is booked could be ok.

I just took the test, i have a degree and only got just over 50 % (my wife beat me with 70) ! Think my next step will be to scan the web for test help.

There is no link or any precedence. I have mentioned this out of experience. In fact it is more complicated case.

A couple applied for ILR where as the spouse did not take Life in the UK test as she did not complete 5 years ( she was short of 3 months )e worker

The Case worker kept the case on hold for 3 months, then realized no Life in the UK test.
When requested she sent the passport back, the spouse wrote the test and sent the passport and the result back.
They were granted ILR a week later.

Do not expect all case workers to be like that, as long as you have another piece of ID ( if you do not send your passport along with the application then it will be invalid )to write your test the you can send it later when you get your case ID.

And lastly, frankly speaking you do not have any other option this is the only way out.

Why don't you apply to extend her FLR(M) visa and if you send it via the post, then once she has passed LIUK on 25th Feb (hopefully) apply to vary the application to ILR on SET(M)

Yes, the policy guidance says that you can send life in the uk test later. send setM applic abd B1 with all supporting documents and explain the situation in a covering letter,
