Marrying asylum seeker

Post by annac444 » Mon Feb 17, 2014 2:12 am

Hi,
I'd be grateful if anybody can help me? So far nobody could help me find an answer to that.
A bit of a background
My family is asylum seekers in UK, my mother being main applicant. I'm dependant on her case as a family member. We came to UK in august 2007. My mom'a case has been refused couple of times, we had judicial reviews at the high court and now our case is in tribunal. However we've not heard from the home office for 2 years now. Home office tried to separate me from my mom's case as I am now 21 years old. However our solicitor made sure I stayed with my mom.
2.5 years ago I met my boyfriend. He is a British citizen. A year later he proposed to me. We have been putting the wedding off because of my uncertain status in the UK. But we would really like to finally get married as we want to live together and start a family.
So the question is am I allowed to get married to my boyfriend? I went to a couple solicitors and everybody's saying they're not sure as I am not the main applicant on the case. Also if i can get married how would that affect my mother's case? Would I continue to stay with her or will I have to apply for a separate visa?
Thank you very much

So far as you still meet the definition of dependant as per Asylum Support Regulations 2000 (regulation 2) paragraphs (4) and (5). Sometimes at the point of application for ILR the dep is expected not to be living an independent life. You should discuss this with the solicitor who is dealing with your case. Also get your MP involved, if not already.

Thank you for repying Amber. I did ask solicitor who is dealing with our case but she refuses to consult me on this matter as it's not her area of practice. Our local MP was involved few yyears ago but Home office refused to accept any letter of support from him.
I know that to get married I need to get certificate of approval from home office. Is there any chance they'do give it to me in my situation? Or chances are pretty slim?

You do not need a CoA. You need to speak to the superintendent registrar at your local register office. S(he) will let you know if they're willing to marry you both.
