In South Africa we can complete a late registration of birth and obtain a birth certificate that way. Not sure what the rules are in Nigeria. Would it be possible to register your birth now?
Also, the form requests a birth certificate naming your biological father that was issued within one year of your birth. If you don't have that, you will need additional documentation such as I had to provide.
Thank you for your time. In Nigeria, an adult cannot register his or her birth. You can only get an age declaration. Then again, I know of someone who has a laminated certificate. Can he use that for himself? We read that they don't accept laminated birth certificate. Thank you!
Hello laura , this might be coming a bit late but if u've not gotten help yet, am here to give you a good news . I understood your situation very well because i was in ur shoes at some point . In my own case, i couldn't find my birth certificate at birth too but i went for another option. If you go through the ukf guidance u will see the required ducuments as listed below.
If you can provide genuine and reliable documents, we will recognise a man as
your father in the following circumstances:
• He is named as your father on a birth certificate issued within one year of your
birth, or
• A DNA test report shows he is your father, or
• A court has ruled that he is your father, or
• You can provide other evidence that is sufficient to establish paternity.
Note the essence of this document is to establish paternity
Dna test - So if u don't have a birth certificate as u've said then u can summit a DNA results from any uk approved centers in nigeria if u reside in nigeria or any part of the world as long as is ukba approved center, u will not be forced to do this to make your claim and it has to be voluntarily done, then this could replace ur birth certificate requirements. (Pls note this option will work if your father is still alive)
Court ruling / Court order - in this option you need to request a court order in the high court in nigeria with supporting documents that you father is your father ( how to go about it) -- get a lawyer to help you fill for knowledgement of parternity that your father is your father with the supporting ducuments like proof of pictures on your naming ceremony at birth, proof that your father pays for your up keep, school fees and so on generally just to satisfy the court truly your father is your father whether is alive or not and if your father is alive then u can have him make a voluntary aknowledgement of paternity , here you have 2 in 1 options, if you are successful with that then the court will issue a court order / declaration that your father is truly your father. This can also replace your birth certificate.
Other sufficient ducument to establish paternity -- this option is also not that complicated, sufficient documents is not fully explained in the guidance but the most acceptable document is will. Meaning if your father is late and you are included in his will as his daughter. Then this is also acceptable to replace your birth certificate.
The whole idea is simple and the home office has allowed this options to accommodate different situations. Eg (having your birth certificate issued at birth )or ( if your father is alive you can get a dna test done to establish paternity ) or (court order by satisfying the court with sufficient proof whether you father is alive or not and if his alive you can have him go to the court to make a voluntary a knowledgement of paternity before the judge or commissioner of oath at the high Court and have it notarized ) or ( if you are included in his will if he has one )
Pls note you can only get this right if you have authentic documents
******So when you have either of the 4 options listed above with your father's British birth certificate then you can apply for the british citizenship by registration, under this sections 4i, 4g & 4h figure out which section that applies to you.
Also you have options of ducument u can provide from your father too
Father's birth certificate or
Father's British passport or
Father's certificate of registration or
Father's certificate of naturalisation
Legitimacy and paternity is key thats all you need to proof.
note for you to find your self in this category of ukf it means your father is not legally married to your mother .and If your parents later marry then you may be a british citizen already and you have to apply for another category of british citizenship.
In conclusion with my own case as have said that at some point i was in your shoes , i currently have my application submitted and i did my bio metric 3/11/2020 and waiting for the outcome. My father is british/nigeria and not legally married to my mother, i was born in nigeria so am nigerian with the help of the uk nationality law amendments now, i qualify to register as a britishcitizen, my father became british in 1974 which was 6 years before i was born , at the beginning of the application i could not find my birth certificate issued at birth and my father is late now but i have his certificate of registration as britishcitizen, first and second british passport issued in uk with me here in nigeria, i got a lawyer in the uk and she explained my chances to me so i went for the court order option because i have supporting ducument to secure that though it took about 6 months after several sittings at the high Court before the judge later granted the declaration. So that was what i submitted in place of my birth certificate .
I hope laura gets this information and i further advice anyone that know anybody in this situation to read and get helped.
