ILR Based on 10 years Long residency

Post by sheikhjee » Tue May 01, 2012 4:02 pm

Dear All,

I have applied ILR 01.02.2012 and fee deducted 07.02.2012 based on 10year long residency. My question is that during this 10 year in 31.03.2004 my student visa was expired and I send my application before expiry of my visa, all my documents was send back by home office as sponsor letter and his bank statement was missing,Then home office asked me to send back application within 28 days which I send again and 14.04.2004 I received my student visa, Is this a break in my long 10 year residency or under section 3D of immigration act it is ok.
2nd question is that in November 2006 my student visa again have been refused by home office and I received back all my document, but they allow me to apply again with in 7 days as fresh application and then again I send my student application within 7 days and accepted by home office as valid application? Is that a break in my long residency?
From november 2006 to 06.04.2008 my document and passport was with home office and then in april 2008 I got work permit and then instead of student visa home office stamp my work permit and I hot my passport back.
My question is , that period from november 2006 to 06.04.2008 is my legal period for long residency under section 3c of immigration act?
My current status is HSMP Tier1 visa and all application for extension made before expiry of current visa during 10 year.
With Regards,
Sheikjee

What were the circumstances of the refusal in 2006? Were you given the right of appeal then?

Thanks for reply,

In november 2006 they refused my student application based on that the course I was study was not graduate course as I already pass my ACCA final exames (28.02.2002 date of entry in uk to 30.06.2006)at that time and then I change the course, took admission in Graduate programe and send back fresh application. and also they did not give me right to appeal against that decision instead they ask me to apply again with graduate programe with in 7 days which i did and that application have been accepted by home office as valid application.
