possible gap in 10 yr long residence

Post by jamiluddin » Fri Aug 10, 2012 5:48 pm

I would be in uk for almost 10 years .I am very much worried at my current situation.

I've recently received my SAR(Subject Access Request) from homeoffice. On one occasion my student visa was valid until 30 September 2005. I applied for an extension through my university that time. 30th September 2005 was Friday ,and homeoffice received the application form on 3rd October which was a Monday. In one file homeoffice marked it as on time application and in another page it’s mentioned as Out of time application by 2 days. Do you think it will be an issue? Another problem was that on 17th October 2005 Homeoffice returned my application saying that I have sent an outdated application form and subsequently i filled up latest form and home office received the form on 27th October 2005. homeoffice did not refund my visa fee and they did not ask for any more fee in the later application. But on my SAR they have written invalid on my first application form and the visa outcome was rejected for the first application ,although they granted me visa for second application.
I want to know if i have a gap now ,or even if i have a gap can i ask for discretion as it was universities failt sending an outdated form. i would apply with a solicitor if any of you can suggest me .Thank you.
