what is a complex case

Post by egoneo » Thu Oct 18, 2012 3:08 am

i went to PEO to apply for leave to remain under private life route, but at the initial checking stages they said it was a "complex case" and i would have to post it.

1. does anyone know what a complex case is?
2. can you apply at PEO for any private life routes?
3. if you can why does FLR(O) application say only long residence cant apply at PEO

thank you so much for your help

Have you read through the new guidelines on 'private life' applications introduced on the 9th July? Under which family route are you applying and why haven't you applied for ILR previously if you have been in the UK legally for 14 years?

yeah i have, im applying under the 276ADE(V):

"is aged 18 years or above and under 25 years and has spent at least half of his life living continuously in the UK"

i'm 23 currently. the reason i haven't applied for ilr(i've tried before) is because i have a gap in my stay in 2007(sent application in on time before leave expired but they returned it when leave expired due to an incomplete form, gave me 28 days to return it but to them that constitutes a gap)

i want to extend my leave using private life, but can you apply at PEO for private life? since they haven't explcitly said on the guidance notes that you cant apply using private life route(theyve only mentioned long residence applications are not accepted), are we to assume there are some private life routes that are "straight forward" and can be done at PEO?

thanks for your help

As a Tier 4 (General) migrant, what aspect of "private life" are you referring to?

Are you married to a British citizen?
Do you have any child who is a British citizen?

276ADE comes under "long residence" (276A-276DH).
Now, see 34B(i)(f).

There wasn't any gap if you had responded within 28 days.
