Impact of change in employment contract terms - WP holder

Post by captain74 » Fri Dec 08, 2006 3:22 pm

Hello All

My wife is in the UK on a WP and is due to join back after taking maternity leave from her job.

Due to added responsibility of caring for the baby, we are thinking of negotiating better terms of employment with the employer. Essentially, this means taking 25% lesser salary for better terms (i.e. lesser resposibility at work though in the same designation as a departmental manager).

I am wondering if this would have an adverse impact on the case we build for ILR application in a couple of years time as the salary would be less at that time as compared to the one mentioned on the initial WP document issued by the HO.

Can anybody help/advise?

Thanks

Hello,

Well, wages is an employment issue. The minimum amount of money a person may get under the WP rules was about 190 UK pounds a week or not less then the current 5.35 pounds/hour.

I understand that your wife will be getting much more then that even after the intended reduction in pay.

So far - nothing to really working in relation to your future ILR application.

Regards,

Anton

Thank you antontony

The wages my wife will get after the reduction will still be more than the national minimum wage.

My concern is -

The application form for settlement asks a specific question 'what is your monthly salary?' The answer to this would be a different figure from that quoted on the WP document.

Will this lead to the settlement application being refused on the grounds that the employment is not the same for which WP was granted?

Regards
