When does the residential qualifying period start?

The residential qualifying period is calculated from the day when we receive your application. Most unsuccessful applications fail because the applicant was not present in the UK at the beginning of the residential qualifying period. You must make sure you meet this requirement before you make your application. For example, if we receive your application on 25 March 2010, you must show that you were in the UK on 26 March 2005.
I have question on above requirement. i came to uk on Dec 2006 and then out of uk from Oct 2007 to Mar 2008. I got my ILR on Dec 2011. my question is if i am eligible to apply for BC now or need to wait for Mar 2013 as was not in uk in Jan 2008.
Please advice.

You will have to be present in the UK 5 years prior to the date UKBA receives your application. However, if you are applying as a spouse of a BC the qualifying period is 3 years.

thanks for quick reply... but like in my case... i was in uk in 2006 and completed more then 5 years... but was out of uk on date i m apply i.e. applying on 12/01/2013 but was out of uk on 12/01/2007... please advice.

As I understand you were out on the 12/01/2008? When I was applying, one of the first questions NCS asked was were you physically present in the UK 5 years prior to the date the application will reach UKBA? If I were you, I would think twice before submitting the application on 12/01.

You will need to wait till the date in March which will correspond with the date when you physically arrived back in the UK in 2008.
