Hi all

I will be applying SET(M) in April in shaa allah I was granted spouse visa in March 2011 and came to UK on it on may 2011, during my stay I travel frequently to Dubai, Turkey, Fareast, India on business trip and once for Marriage anniversary, but all were between7 days to 2 weeks at a time then a 6 - 8 weeks in UK. My Earning are from out of the country, my spouse who is British who work for major organisation her salary is also more then 20K, some bills such as mortgage, gas and electricty on her name and tel, broadband my name plus bank accounts, I took IETS in Jan 2011 plus I have master I have some queries regarding the same

a) is my case straight forward for premium service ?
b) does my wife has to come along with me for interview ?
c) is the IELTS which i took 29 months ago will be alright ? or do I have to appear again as IELTS is valid on for two years ?
d) is the form SET(M) right one ?
e) can you please list documents ?
f) what other document for absence in UK to show they were all business trips
g) Do I have to sit for life in UK test ?
h) when & where should i apply for Boimetric permit?
i) should I hire a lawyer will it be better ?

I can answer some of your questions but not sure on others :
a) not sure if all your absences make it straightforward also you state that you earnings are from outside the UK
b) Yes, your wife needs to go with you to a PEO appointment. If she can't, she will have to write a letter.
c) I think English language cannot be older that 24 months, but not 100% sure.
d) If you are on a spouse of BC visa, then yes, SET(M) is the correct form
e) Section 10 of the SET(M) form tells you what documents you need
f) not sure
g) Yes, you have to do the Life in the UK test as you need to submit the pass notification and it is best to do the test at least a few days before you attend a PEO as it takes a couple of days for the results to upload to the UKBA.
h) If you apply at PEO, your biometrics will be done on the day of your appointment. you don't need to apply for this before your appointment,
i) That is your choice depending on how strong you feel your case is.

Thanks for your prompt reply ... I contacted online immigration consultant they thingk as for ILR absentees from UK will not effect my application but have to be explain these for my citizenship...... they were ready to represent me... But they are just consultants and not Lawyers....what are the difference can anyone put some light on it ?

I would strongly suggest if you are going to use a representative, that it is someone who is OISC registered and is fully knowledgeable on immigration rules/laws. Not all solicitors/lawyers are as immigration is not their main business.
