spouse visa to ILR

spouse visa to ILR

My wife is ILR and applying for British citizenship, we got married 2 yrs ago. i was student on tire 4 for 3 years before. So i am on spouse visa which is going to end with in 6 months.

my questions are:
1. can i apply for British citizen,(its been 5 years staying here) or I should apply for ILR first?
2. Which form Should i use?
3. Which documents should i submit with the form?
Please help me with right guidance.

you cannot apply for citizenship until you have ilr because you have to be free from immigration time restrictions. if your wife has her british citizenship when youget your ilr, you can then appky for citizenship immediately as spouse of bc and the residence rquirements are 3 years with absence of no more than 270 days in the threeyears and no more than 90 days in the 12 months before citizenship application.

are you on spouse of settled person visa?
when did your wife get ilr?
what date was your visa issued and what is the expiry date?

my wife got ilr 6 yrs ago on 04/2007, so she is going to apply for bc. her visa expires after 2 months. i am on spouse visa now, married 2 yrs ago and my visa is till july 2013.
which form should i use for ilr. and how much will it valid for?

form set(m) and it is indefinite with no expiry.
bear in mind that you will need your wifes passport and ilr to submit your application as well as all the other documents.
if your wife applies for bc, i would suggest she uses NCS so that she can keep her original documents.
once your wife has bc certificate and you have ilr, you will be eligible to apply for bc immediately as spouse of bc. as resident requirement is 3 years so you wont have to wait 12 months on ilr.
