Visa status when application by post

Hi everyone,

Further to my last post, just wanted some clarification on what a persons status is if applying for FLR (M) by post and their visa has expired whilst the application is being assessed?

What would happen in this case if the application was refused and took around 6 months after their visa expired?

Any help appreciated.

You remain legal under the original category of visa until the application is decided.

Many thanks for your reply. I was also wondering just as a 'what if' if they were to refuse the application would there be a grace period for them to re-apply or would they have to leave immediately and then be classed as an overstayer?

Section 3C should be applicable, provided that you made a valid in-time application.
