Naturalisation in Oct 2013

Post by eureka_ilr » Wed Feb 13, 2013 1:23 pm

We got our ILR in Sept 2012. We have since spent around 60 days in India celebrating the ILR :-). We are within the 100 days rule for the last year before naturalization

Our long term plan is to spend a year or so in India . We are just waiting to get through the next door i.e. naturalisation

The plan is :

1) Get naturalisation after 12 months (in fact a day after the day I entered UK in 2007 i.e. 11th Oct 2007). So we can effectively apply on 12th Oct 2013 ?

2) Wait for the time to get naturalization and/or the passport. How long will this waiting period be after 12th Oct 2013?

3) How long after that to get OCI card?

4) Anything else I need to worry about. I have 6 points on my license which I got in 2008/2009. Do I need to worry about these? They didnt affect my ILR.

Any comments/answers welcome. Very grateful to the good souls who've guided us all along.

Hi,
I will answer what I can :

1) Get naturalisation after 12 months (in fact a day after the day I entered UK in 2007 i.e. 11th Oct 2007). So we can effectively apply on 12th Oct 2013 ? - were you physically present in the UK on 12th October 2008?? that is a standard requirement of physically present in the UK exactly 5 years to the day that UKBA receives your application.

2) Wait for the time to get naturalization and/or the passport. How long will this waiting period be after 12th Oct 2013? - I applied October 2012 and my approval took 6 weeks, but guidelines are that it can take up to 6 months for approval letter and then it will depend on how quickly your council has appointments available to attend the citizenship ceremony to do the oath and get your naturalisation certificate. Once you have the certificate and you apply for your first passport, that can take up to 6 weeks.

3) How long after that to get OCI card? - from reading other posts, I think you have a grace period of 3 months within which you have to apply for OCI but I am not sure how long it takes.

Thanks for your kind reply CR001

yes I was present in UK on 12th Oct 2008.

Oh I just realised its not 12th Oct 2007 rather it's 12th Oct 2008. Now I get it. Thanks once again. so its got nothing to do with the year I entered UK rather one year after that (and therefore 5 years before the naturalisation application)

Does this mean that I can apply immediately after completing 12 months since ILR. So I can infact apply on 12th Sept 2013 given that:
-I got my ILR on 11th sep 2012
-I was present in UK on 12th Sep 2008

Yes, you can apply immediately once you complete 12 months on ILR, so September is fine as long as you were physically present 5 years before.

Did you have to go to court for this? If so, you will have to list them.

Otherwise, did these infractions come as Fixed Penalty Notices (FPNs)? They are willing to overlook one FPN (as long as it's not drink-driving or using a mobile while driving, these are no longer considered "minor offences"), but if you received more than one FPN over a period of 12 months, you will have to list these as well.
