spouse and child of settled person eligible for ILR?

Post by shahid2000 » Tue Feb 19, 2013 9:26 am

Asking this for a friend.

She got married in 2009, husband had ILR at that time and still has ILR. She initially came to UK on visit visa and left before it expired. From her home country she applied for spouse visa.

Spouse visa valid from 10/01/2011 until 10/04/2013
She entered UK on spouse visa on 15/03/2011

Is she eligible for ILR on 15/03/2013 ?

Their son was born in Malaysia in 2010 and hold Malaysian nationality. He also got the dependant visa and entered UK 15/03/2011.
Is the son eligible for ILR on 15/03/2013 ?
When can the son apply for british nationality?

Actually, they may apply for ILR by post now.

Son may register for British citizenship at the same time when his mother is eligible for naturalisation.

Thanks Vinny, they have already booked a PEO appointment for 20/03/2013. As i understand it by that time they will have been in UK for 2 years so they can apply using PEO.
Is that correct???
