Few questions regarding ILR based on 10 year residence

Post by Karaduman » Fri Feb 22, 2013 11:30 pm

Hi guys,

I stumbled on this website while looking for information regarding my 10 year long residence application. And I have to say it is absolutely amazing. I was actually thinking of going to a lawyer with my questions but the amount of helping that goes on here is phenomenal! Thank you so much for all the people who put the effort to read all those long messages (mine included :) ) and actually respond with extremely useful information. So I have a question that I would love some answer for:

A little about my background: I am a Turkish national living here with my family. My visas is dependent on my dad's who has an Official Exempt visa, which is the same one as mine. These were given in the following order:
- 1st for 1 year
- 2nd for 4 years
- 3rd for 2 years (with some overlapping with the previous one)
- 4th for 1 year
- 5th for 2 years
- 6th for 1 year

I am 24 and have entered the UK in Dec 2002 so my 10 years are done, with no gaps of more than 6 months. Just a few weeks gap between the visas but thats because of the slowness of the Home Office in processing our visas and I have letters showing that the passports were sent to them in time. I have been a student all this time: GCSE, A-Level, BSc, MSc and now I am doing medicine (finish in 2015). I did work at a few part time jobs so I have a NIN. So my questions are:

1. As I am a poor student, my account has a -£2000 balance on it :D I have been a student for a long time I guess hehe. So my questions is will this be a problem? I heard from someone in a similar situation as me that they returned their application because they didn't have the means to support themselves???

2. I currently live with my family. My parents pay for everything. I also heard (from a lawyer) that when you apply you are required to send a tenancy agreement showing that you are renting a place and paying for it. Is this correct because I didn't see such rule anywhere.

3. Foolishly I booked mt summer holiday for June thinking that I can get a premium application. But after finding that I can't and that most postal applications take more than 6 months I am thinking of applying after my holidays. Now I have also heard that there are plans from the government to change this 10 year long residence rule. I am worried that by June everything will change and I will not be able to use this right. Is there any basis for this?

4. I have a current visa that runs until the end of the year. Do you guys think that the UKBA might say there is no need for me to apply as I already have a visa and that I should apply once my visa is about to expire? Because my visa is linked to my dad, will I have to officially separate from him?

5. More of a technical question. I looked through the SET(O) form and there are lots of questions which are not relevant to the long resident application. So do we send the application form as a whole?

Thats all what I have for now. Thank you so much for taking the time to read it and helping out.

O and I have my Life in the UK test this Wednesday so wish me luck :)

Best of luck to everyone,
Ser

See also Long residence.

Note that:
Long residence wrote:If a person applies for leave while they are still exempt, you must inform them their application will be considered once their exemption ends.
1. See their instructions.
2. Living with parents should be okay.
3. Don't know.
4. See above.
5. Send the whole application form. Answer applicable questions. Make sure that the application is valid.
