EEA family permit for Romanian National?

Post by woeisme » Wed Mar 13, 2013 4:59 pm

Hi all,

I'm doing a bit of case work for a friend and I seem to be at an odds with what to do with this particular case.

Basically, there is a Hungarian Woman who has been working and living in the UK who wants to bring over her Romanian Father. From what I have gathered, the best way to get him here is on an EEA family permit as I'm not sure he qualifies as an EEA member because of the status of Romanian. Am I correct in this assessment? If he does need an EEA family permit the Immigration Law handbook states he must show dependency to be eglible for the permit. If this is what he needs, how do we establish dependency?

If you could provide some guidance in this situation it would be greatly appreciated. Cheers

EEA family permit is not needed to Romanian nationals for entering UK rather they can freely enter and they can continue to live as long as excercising their treaty rights such as student, self sufficient and self employment.

Romania and Bulgaria has already officially joined EU in 1st January 2007 and therefore their nationals are already entitled for free movement besides facing work restriction as part of UK transitional measure that can only last for maximum 7 years.
