Urgent help needed...

Post by pinkpop » Fri Mar 22, 2013 7:44 pm

Hi guys

Please help with my situation. Your help are very appreciated

Background

I came into England at year 2000 as a student and Switched to tier 1 dependant visa(entry clearance)on 04.2009. I have applied for the SAR report to check wether I continuously lived in the country for 10 years at year 2010. As soon as the report came back and I noticed that In the personal notes under CID section shown local immigration team requested my ho files by one of their chief immigration officer on date 10.2009 and the files received by them on 03.2010. After that I have not applied ILR under 10 years route, at year 2012 I have extended my visa by another two years.

Question is
1. Anyone come cross this before? Any experience about this(your ho file been request by local immigration team?

2. What could it be for LIT requesting your files?

3. It is 3 and half year now Since LIT requested my file, nothing happen to me and also got visa extension successfully. Depending on this do you think it will effect me when I apply ILR at 2014.

you haven't mentioned the main observation that you originally intended to check in your SAR file - have you lived in the country continously for 10 years, since 2000? Also why are you hesitant to apply for ILR?

I don't know anything about you so I can't say why your files were requested. You know your situation better, so if you you don't have any past immigration related issues, then I don't see any reason to worry or delay the application.

Thanks for your reply.
I request a SAR to check any gaps during the period unfortunately there are some gaps. I do not have any problems or issues when I extend my visa not even a refusal for last 13 years.

Now I am a bit worry about why the LIT request my file.

It is not whether you faced any issue with your past extension applications but whether you violated any conditions of your previous leave(s)?

If you are aware that you violated your leave conditions in the past, either knowingly or unknowingly, then you need to provide details so that people can comment accordingly.
If there are no such violations, and you know you have a clean immigration history, except the gaps, then don't worry - apply for ILR once you overcome the gaps and meet the residential requirements.

A chief immigration officer is normally stationed at one of the UK ports. What happened prior or during 10.2009? Did you have problems entering the UK?

If you qualify under Long residence, then you may apply for ILR. KOL required.

Thank you. As I mentioned in previous post I have few gaps and not qualified yet but I am under t1 dependent and will be able to apply ILR in 2014. I have already passed Life in the uk test three years ago.

Basically I came here for help from anyone has same concerns or anyone has experience and advises or anyone may know this issue.

Thank you very much again vinny.

It's unlikely that anyone here, with limited information on your situation, will know why a chief immigration officer had requested your file. Nor what the consequences are.

You may have met with one of his officers who had been concerned for some reasons or other. Or, s/he may have requested it in error. Who knows?

If you were subsequently granted leave, then the reasons were probably not sufficient enough to refuse you further leave.

No worries. In future please post in one section. Then you would get the best answer to your queries.Other wise you will get different advises and you will be confused. Members do not get paid for their advises. They are only trying to help,in their free time, which is wonderful.
