Naturalisation and British Citizenship Process

Post by Raghav1978 » Thu Apr 04, 2013 9:12 pm

Hi

First of all I would like to take this opportunity to thank all the moderators and Gurus of this great forum. I have been following this forum since my ILR days (Nov 2011). The resources and solutions provided on this forum are unbelievable and of great value. :)

I would like to post my naturalisation and British Citizenship query in this forum having posted my last ILR success story back in May 2012.
I am now eligible for the Naturalisation and British citizenship for myself, wife and Son in May 2013.

Timeline:
Got ILR approved on 8 May 2012 (Myself, Wife and Son).
 I came to UK in August 2004 on a student visa and renewed my student visa till June 2007.
 Got HSMP approved on June 2007.
 ILR approved on 9 May 2012
Absences: less than 230 days over last 9 years (student and HSMP, Tier 1 general, ILR).

Queries:

1. Form needed for NATURALISATION and Citizenship? (I have been hearing forms have been changing or changed for AN or MN in April 2013)
2. Applying for myself, wife and son AND FORMS NEEDED for all (do I need to fill up separately for myself, wife and son)
3. Payment form? As I will be paying for all the three application fees do I need to use same payment form for all or do I need to use form separately for everyone? Can I use credit card for the fees?
4. I have booked appointment with NCS Croydon (Check and send) for my family on 10 may 2013. Does the date have to match 09 may 2013 or any date after 09 may 2013 or BRP card received date (12 may 2012)?
5. I received my BRP card only on 12 May 2012 so do I need to send the forms on 09 may or 12 may 2013? (I have booked NCS appointment on 10 May 2013 so is it ok?)
6. I am self-employed person (paid all taxes till date and paid my advances for 2013 first half of year). so what are the required documents do I need to send along with the form? Do I need to furnish P60, payslips (previous companies), tax history for all the years or just a HMRC tax history covering 6 years?

My wife s timeline: ILR approved on 09 may 2012.

Timeline:

I. She initially came to UK on June 2007 on a working holiday visa (2 year) and we got married in Dec 2008 and she got her tier 1 general dependant visa in March 2009. Does she qualify for naturalisation along with me or does she have to wait till I get naturalised and apply for her British passport. She is legally in UK since June 2007 (5 years 11 months). Does she fall under 3 year spouse category or 5 year?
II. She has got absences of around 440 days(maternity and holidays) over 5 years and 11 months (may 2013) so does these absences count towards 3 year(270 days) or 5 year category(450 days). Keep in mind she is legally in this country since 2007 (firstly on working holiday and then tier 1 general dependent).
III. Is she is eligible to apply for her naturalisation along with me?
IV. What are the supporting documents required to be submitted along with the forms. (She is currently working)?

Son: ILR approved on 09 may 2012.

Timeline:

 Born in India (Sep 2010) and came to UK on May 2011. is he eligible to apply for his naturalisation along with myself and wife on 10 may 2013?
 Form needed?
 Documents needed? (We have his birth certificate from the city municipal corporation and hospital letter supporting the birth date).

I would be grateful if any of the moderators or gurus will help me in answering the queries (Though lengthy one :D ).

I would like to thanks one and all on this forum that has been very supportive and helpful for those people who are posting queries and clarifications and getting valuable help.

Thanks
Raghav

Queries:

1. Form needed for NATURALISATION and Citizenship? (I have been hearing forms have been changing or changed for AN or MN in April 2013) Current forms, AN for adults and MN1 for children should be fine as if there are new forms they will be available from 6th April.
2. Applying for myself, wife and son AND FORMS NEEDED for all (do I need to fill up separately for myself, wife and son) AN and MN1
3. Payment form? As I will be paying for all the three application fees do I need to use same payment form for all or do I need to use form separately for everyone? Can I use credit card for the fees? - http://www.ukba.homeoffice.gov.uk/sitec ... y-fees.pdf - not sure if you need one form for each application but NCS will be able to advise you and I am sure you can write 1 amount on the form with the names. Yes, you can use a credit card.
4. I have booked appointment with NCS Croydon (Check and send) for my family on 10 may 2013. Does the date have to match 09 may 2013 or any date after 09 may 2013 or BRP card received date (12 may 2012)? The date of application is the date that the UKBA receives the applications and all applicants will need to have been physically present exactly 5 years before, to the day.
5. I received my BRP card only on 12 May 2012 so do I need to send the forms on 09 may or 12 may 2013? (I have booked NCS appointment on 10 May 2013 so is it ok?) What is the date of ILR issued listed on your BRP? You need to apply exactly 12 months after this date.
6. I am self-employed person (paid all taxes till date and paid my advances for 2013 first half of year). so what are the required documents do I need to send along with the form? Do I need to furnish P60, payslips (previous companies), tax history for all the years or just a HMRC tax history covering 6 years? Employment is not a requirement for naturalisation.

My wife s timeline: ILR approved on 09 may 2012.

Timeline:

I. She initially came to UK on June 2007 on a working holiday visa (2 year) and we got married in Dec 2008 and she got her tier 1 general dependant visa in March 2009. Does she fall under 3 year spouse category or 5 year? She will fall under the 5 years category as you are only British once you attend the ceremony and receive your certificate. She will only be considered under the 3 year rule once you are British and I have not yet seen any joint applications in this manner succeeding but if she has 5 years residence, she will be fine to apply with you.
If applying on 5 year category, her absences are fine. What are her absences in the last 12 months??
III. Is she is eligible to apply for her naturalisation along with me? Yes if she has ILR for 12 months and residence for 5 years in any legal status
IV. What are the supporting documents required to be submitted along with the forms. (She is currently working)? The form and guidance notes list what is required but would be similar to what you provide with your application.

09 may 2012 is the date i got my ILR approved - what is the issue date on your BRP? This might be different to the day you attended a PEO appointment and got approval, for example, if you had your appointment on 9th May 2012 and got y our BRP on the 12th, the date of issue for your BRP might be the 10th May.

what are the required docs as i couldnt understand the docs requirement. - as stated, you don't have to be employed to apply for naturalisation. Read the guidance notes for form AN : http://www.ukba.homeoffice.gov.uk/sitec ... ide_an.pdf - section 3 - Good Character specifically, so perhaps include documents to prove your tax affairs are up to date etc.

she has less than 30 days of absences in the last year - she will be fine then if applying on the basis of 5 years residence or 3 years residence once you are BC and has max 270 days absence in the 3 years with max 90 days in the 12 months before applying
