Dependent Visa - important query

Post by orapisces » Wed Apr 10, 2013 1:41 am

Hello everybody,

It's my first time here, please accept my apologies if I miss any rule.

I am due to apply for my ILR in September/October 2013 (I am on tier1 general migrant visa). Now I am planning to get married in July and apply for my wife(to be) visa. It means that in October my visa is expiring; my question is, would that be OK to apply for her even my visa would be expiring in 2/3 months time.

When she gets the visa, for how long that would be valid for? Can any one help, please?

If you have leave under Tier 1 (General), then you wife may be granted entry clearance that expires in line with yours (319D(a)(i)).

If you subsequently apply for ILR under Tier 1 (General), then she may also extend her leave as a PBS dependant.

However, if you subsequently apply for ILR under Long Residence, then she should switch to FLR(M). Note that switching to FLR(M) also requires that her entry clearance is valid for more than six months.
