gf on tier 5 - can she switch to spouse visa?

Post by hanselg » Sat Jun 01, 2013 7:31 pm

Hello
I am a British citizen. My gf from Sri Lanka is here in England on a tier 5 visa (charity worker). She came here in December and has been here for 5 months, though she needs to live where her charity work is.
We have known each other for a few years now and plan to register our marriage soon, i.e. before her tier 5 visa runs out.
Pls advice if she can switch to a 'spouse' visa?
When is the best time to register our marriage?
Thanx

Thank you very much for the link.

I had a look at it, but am not able to understand what is meant by "on temporary admission"
Does this by any chance refer to Tier 5?

I am copying a portion of the page below for your reference:
You cannot apply to extend your leave to remain if you are in the UK:
as a visitor;
with permission to stay for a period of less than 6 months (unless that leave was as a fiancé(e) or proposed civil partner);
on temporary admission; or
in breach of the Immigration Rules (a period of overstaying of less than 28 days will not be taken into account).
I will be grateful if you could please explain that to me. Thanks

No, Temporary admission doesn't refer to Tier 5.

Temporary admission or release is under paragraph 21 of Schedule 2 of the Immigration Act 1971.
