ILR Premium Service but no response after 2 months

ILR Premium Service but no response after 2 months

I applied for ILR in the premium service on 3rd April 2013 with 4 dependents. I applied through consultants and was told to get the result on the next day as it was already 5 pm and office was getting closed.

A query was raised next day regarding self employment and the answer to be provided to case worker within 14 working days. I provided the required documents within 7 working days to the case worker.

Since then there is no response from the HO ( case worker) on the status of my ILR.

My employer has also given my one month notice for not having valid visa.

Has some body been through same experience? Please suggest what should I do:

Should I contact Home Office or write a letter to them?
Is there any link regarding immigration rules so that I could print for my employer not to sack me when my case is in process with Home office.

Please do share you experience or give suggestion.

Hello Khanpsm,

There are other people in your situation but note that you employer can not terminate your employment on the bases of visa since the home office is processing your application.

You writing or call will not change anything.

Is it okay if you state what the self employed query is?

What I can advice at this time is to pray or keep praying.

Section 3C under immigration act is protecting you against illegal stay / work. Existing visa continues to cover you untill receipt of final decision from UKBA, although the decision is made after visa expiry.

In case of visa rejection, it continues to cover you untill the deadline for appealing and further extended if an appeal is submitted.

Section 3C will extend your existing leave with your right of work till decision. You can explain this rule to your employer too and even UKBA has got its special helpline for employers to check the status of their employees at below:
