Evidence of Continuous Residence – Not required by the NCS?

Post by mra » Wed Jun 05, 2013 1:29 pm

Hello,

Yesterday I submitted my naturalization application (AN Form) using the NCS service. The NCS staff member was very courteous and attentive. She took photocopies of my P60s, EEA (Portugal) ID card, UK Driving Licence and passports (I hold dual citizenship Brazilian and Portuguese). I do not have the PR card.

However, she did not want to take my last five years bank statements and/or tenancy agreements as proof of five years continuous residence in the UK. She said that they were unnecessary as I have all P60s since 2003.

I assume that the NCS staff knows better as they do it all the time, but I am still unsure whether the bank statements/tenancy agreements are required or not.

Do you think I should post them directly to the Home Office to be added to my application?

I welcome your comments.
Marcelo

Bank statements and tenancy agreements are not required according to list on UKBA website :
Evidence required from European Economic Area and Swiss nationals
Evidence of your nationality

You should provide:

* your passport; or
* your nationality identity card.

Evidence of exercising treaty rights for 5 years

We require evidence to cover the relevant 5-year period. You should provide:

* P60 tax certificates; or
* an employer's letter confirming employment; or
* a benefits letter confirming job seekers' allowance claimed; or
* a benefits letter confirming incapacity benefit claimed; or
* documentary evidence confirming pension received; or
* a copy of your workers registration scheme certificate (if you are registered).

Sorry I think there's some confusion here.
Treaty Rights are composed by residence and work (mainly).
Rental agreements are to demonstrate residence, P60's etc are to demonstrate work.
I gues sshe argued that you have had to be residing here in order to work here.
Did you everything go all right in the end?
