Tom is married to a British National for 4 years and was granted Leave To Remain April 2009. He has never been an illegal immigrant or overstayed. He would have been eligible for ILR in April 2012 but did not do the Life in Uk Test due to Learning Difficulties and some level of illiteracy. Tom was granted 2 years Further Leave to remain April 2010 as he did not do Life In UK test. He was 63 years old at the time.

Tom is now 64 years old. Can he now apply for ILR without the need to have Life In The UK Certificate ? Does he have to wait until his Further Leave To Remain visa ends?

Tom has to be at least 65 years old to get exemption from English Language requirement.

He may apply for further leave to remain before his leave expires.

He may apply for settlement, without KOL, when he's 65.
