PR as a dependent, who is Independently on Tier1

Post by sriharan12 » Sat Jun 08, 2013 10:54 pm

Apologies, but can't able to correlate any of the FAQ with the situation
I am currently held with.

My wife came to UK in 2008 on Work permit. She took her PR on Feb 2013 along with my daughter who is 2 years old now .

I had my Tier1 issued on March 2009, I came to to UK on July 2009 on my own and from then onwards I am in UK without breaks. I had my 1st Visa extension on May 2012. My actual eligibility for PR is in July 2014.

I am with my wife, since the day I landed in the UK. Can I apply as a dependent of my wife and get the PR, on the clause that we are staying at the same address for almost 4 years now.

No, if you have not been in the UK on your wife's visa as a dependent then you don't qualify. If you switch to dependent of settled person on FLR(M), you clock starts again from 0 and you have to complete 5 years in this category before you can apply for ILR.

There is no 4 year rule. The quickest route to ILR for your is to wait until you qualify in your own right after 5 years residence on Tier 1.
